1. Acceptance of Terms
By accessing or using Hubpost, you agree to be bound by these Terms of Use. If you do not agree, you may not use the Service. Hubpost is operated by PXV Digital Services LLC, a Delaware limited liability company ("we," "us," or "our"). These Terms apply to all users, regardless of location.
2. Description of Service
Hubpost is a subscription-based platform that allows users to create, schedule, and publish content across multiple social media platforms — including (but not limited to) YouTube, TikTok, Instagram, Facebook, X, Threads, and LinkedIn — from a single composer. We are an independent third-party tool and are not affiliated with, endorsed by, or sponsored by any of these platforms. Your use of each connected platform through Hubpostis also governed by that platform's own terms and policies.
3. Eligibility
You must be at least 18 years of age to create an account and use Hubpost. By registering, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete. We reserve the right to terminate accounts found to be in violation of this requirement.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at pxvbusiness@gmail.com if you suspect any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account information.
5. Connected Social Media Accounts
To publish content, you must connect one or more social media accounts via OAuth. By connecting an account, you grant Hubpostpermission to publish content and perform related actions on that account on your behalf, strictly limited to the scopes shown on the platform's consent screen at the time of connection. You represent that you have the right to connect each account and to publish the content you submit. You may disconnect any account at any time from your Hubpost settings; you may also revoke access from inside the corresponding social media platform.
6. Content Ownership and License
You retain ownership of all content you create, upload, or publish through Hubpost. By using the Service, you grant us a limited, non-exclusive, worldwide license to store, process, and transmit your content solely as necessary to provide the Service — including transmitting it to the social media platforms you have connected. Hubpost does not claim ownership of your content and does not use it for advertising or to train machine learning models.
7. Permitted Uses
Hubpost is designed for lawful publishing workflows by creators, brands, and businesses. You are solely responsible for ensuring that your use of the platform and any content you publish complies with all applicable laws and the terms and policies of each connected social media platform, including those governing copyright, intellectual property, privacy, publicity rights, and platform-specific community guidelines.
8. Prohibited Content and Uses
You agree not to use Hubpost to publish, schedule, or facilitate any content or activity that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Infringes the intellectual property, privacy, or publicity rights of any third party.
- Constitutes spam, deceptive engagement, artificial amplification, or impersonation of another person or entity.
- Contains malware, phishing links, or other harmful technical content.
- Sexually exploits or depicts minors in any form, real or synthetic.
- Violates the terms, policies, or community guidelines of any connected social media platform.
- Attempts to interfere with, overload, or disrupt the Service or any connected platform's API.
Violations may result in immediate account suspension or termination without refund, and may be reported to relevant authorities or platforms where required by law.
9. Subscriptions and Billing
Hubpost offers subscription plans billed on a recurring basis (monthly or annually). By subscribing, you authorize us to charge your payment method at the start of each billing period. Subscriptions renew automatically unless cancelled before the renewal date. You can manage or cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period and you will retain access through that date.
10. Refund Policy
We offer a refund on your initial purchase if requested within seven (7) days, provided no significant usage of the Service has occurred. Refunds do not apply to renewal charges. Where permitted by law, a service fee of up to six percent (6%) of the original amount may be deducted. Accounts terminated due to violations of Section 8 are not eligible for refunds. 11. Service Availability
We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including outages or policy changes by connected social media platforms. We are not liable for any loss or inconvenience caused by downtime or by changes to third-party platform APIs.
12. Third-Party Platforms
The social media platforms you connect through Hubpost are operated by independent third parties. We do not control their APIs, policies, availability, or the outcome of any publish action they accept or reject. Each platform's terms of service and acceptable use policies apply to your activity on that platform, including content published through Hubpost.
13. Enforcement and Termination
We reserve the right, at our sole discretion, to suspend or terminate your access at any time for conduct that violates these Terms or is otherwise harmful to users, third parties, or the integrity of the Service. We reserve the right — but not the obligation — to monitor platform use for compliance with these Terms.
14. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted, or be error-free.
15. Limitation of Liability
To the fullest extent permitted by law, Hubpost and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the three (3) months preceding the claim.
16. Modifications to Terms
We may update these Terms at any time. Changes will be posted on this page with an updated date. For material changes, we will make reasonable efforts to notify active users. Continued use of the Service after changes constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
